Senior Manager - Legal Counsel

Purpose & Overall Relevance for the Organization:

This incumbent, reporting directly to the legal director, will assist the legal director in handling various kinds of legal matters and issues which may occur in data privacy, digital and Tech operations in adidas China. He (or She) will also participate in different local and global projects of data privacy as well as eCom growth and expansion, and perform a variety of legal advisory, technical and administrative functions.    

Key Responsibilities:

Data Privacy

  • Conducting necessary privacy impact assessments (PIAs) for all scenarios (both in GCA and global projects) as required by PRC Personal Information Protection Law (PIPL).
  • Drafting, reviewing and negotiating Data Processing Agreement and all other data privacy related terms in various agreements with 3rd parties.
  • Reviewing and updating the general Privacy Statement for consumers, employees and job applicants on a regular basis, and drafting the detailed data processing rules for specific cases (e.g. online/offline campaigns, marketing activations).
  • Supporting the quarterly APP & Mini-program PIPL scan and follow up the rectifications.
  • Supporting the Annual PIPL Audit by coordinating different teams and external auditors, organizing audit working files, and tracking the follow-up actions by different teams.
  • Supporting data breaches/security incidents by working with Global Privacy, Information Security and external lawyers.
  • Working with CS team and HR team to resolve consumers and employees’ inquiries / complaints regarding specific data processing case and their data subject rights.
  • Developing data privacy related trainings and compliance guidelines to key stakeholders (e.g. eCom, OR, CRM, Tech, HR).
  • Drafting legal newsletter for any newly-promulgated law or regulation regarding data privacy, and further supporting the implementation of new legal requirements companywide.
  • Reviewing and updating local Data Privacy Policy and Data Breach Policy on a regular basis, and drafting any new policy (e.g. PIA Policy) at the company level where necessary.

Digital & Tech Operations

  • Drafting, reviewing and negotiating various contracts and other legal documents related to the digital operations, such as agreements with e-commerce platforms, vendors, KOLs/MCNs, collaborators and business partners.
  • Drafting, reviewing and negotiating various contracts and other legal documents related to the Tech operations, such as agreements for IT system development, license, maintenance.
  • Reviewing product descriptions and other contents to be published on the digital consumer touchpoints to ensure full compliance with laws.
  • Reviewing and commenting on key visuals, videos and other marketing and advertising materials and contents for digital business.
  • Providing supports in connection with consumer engagement and digital activation initiatives of adidas China, including reviewing and advising on the mechanisms, consumer journeys, T&Cs and other communications of various campaigns, hype launches and membership programs.
  • Assisting customer service team in handling consumer complaints, governmental inquiries and other similar matters in connection with adidas China digital business.
  • Handling disputes and litigations. Working with outside counsel where appropriate.
  • Participating in company’s digital projects and assisting in the commercial transactions if any, as and when assigned.
  • Monitoring changes and developments in the legal and regulatory environment in China market, and inform business stakeholders timely of the changes and development as well as actions required in the form of newsletters, presentations or otherwise.
  • Assisting the design and delivery of legal and compliance trainings and guidelines, as well as the formulation and implementation of appropriate standards and processes when needed.

 Knowledge, Skills and Abilities:

  • Graduate of a recognized law school either in China or abroad and admitted as a member of the legal profession in China or abroad.
  • At least 6 years’ experience either in the legal department of a multinational corporation or a law firm with an international practice.
  • Experience in data privacy, digital business and FMCG, sports company or retail industry is preferred.
  • Good knowledge of the Chinese legal system and the main laws (e.g., civil laws, company laws etc.) as well as laws relating to data privacy, ecommerce business, advertising, consumer protection etc. Experience in PIA, DPA, data breach case, litigation case is a plus.
  • Must be willing to participate in a team oriented, consensus-building environment. Have potential of managerial skills.
  • Very good communication skills & negotiation skills, comfortable presenting complex topics to stakeholders at various organizational levels both in person and remotely.
  • Must be fluent in English and Mandarin Chinese (speaking, reading and writing).  Have good communication skills.
  • Must be self-motivated and responsive.

Requisite Education and Experience / Minimum Qualifications:  

  • Minimum of 6 years of post-qualified experience in legal
